2. Professional Services Limitation Maritime surveying is an observational and technical process. Our reports (including On-Hire, Off-Hire, and Damage Surveys) are based on the conditions visible and accessible at the time of inspection. INS shall not be held liable for defects, damages, or discrepancies that were hidden, inaccessible, or surfaced after the inspection was completed.
3. Limitation of Liability In no event will INS be liable for any loss or damage including, without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of our services or reliance on our survey reports. The total liability of INS for any claim shall not exceed the fee paid for the specific service rendered.
4. Technical Equipment & Specialized Assets Surveys conducted on technical equipment, containers, pontoons, and barges involve specialized risks. INS provides independent evidence of condition, but the responsibility for the safe operation and maintenance of such equipment remains solely with the owner or charterer.

6. Jurisdiction and Governing Law This disclaimer, and all services provided by International Nautical Services (INS), shall be governed by and construed in accordance with the laws of the territory in which the specific service is rendered, namely South Africa, the Netherlands, or Belgium.
Any disputes arising from or in connection with our services shall be subject to the exclusive jurisdiction of the competent courts within the respective country where the survey or inspection took place, unless otherwise agreed upon in writing by all parties involved in the service contract.
